The long term effects of doctor or hospital error can be devastating. Every day in this country, these errors result in serious injury, disfigurement, and even death.
Sadly, the same health care professionals that we trust with our physical health and well-being can often cause us harm. When medical error is to blame, the law provides a remedy.
Medical malpractice lawsuits are extremely complicated, and should only be handled by an attorney that is well versed in the law, and the applicable medicine. It is crucial to hire an experienced law firm to go up against the large insurance companies and law firms that will defend the physician(s) and hospital.
A bad result from treatment or surgery does not, in and of itself, constitute malpractice. In order to have a viable medical malpractice case, the victim’s injuries must be the result of negligence.
In New York, medical negligence is defined as the departure (or deviation) from good and accepted medical practices (such as a failure to diagnose a serious condition or surgical error).
